Why Is Obtaining an Accident Report Important?

A traffic accident report in Virginia can be a key piece of evidence for anyone seeking compensation for injuries or property damage. Insurance companies often use the report to understand what happened, identify the parties involved, and evaluate potential fault.

In Virginia, the “police crash report” is typically prepared by a law-enforcement officer who investigates the crash and forwards the report to the Virginia DMV. The report generally includes the crash date, time, and location, notes about road/weather conditions, statements and identifying details for drivers/vehicles, and information about damage and injuries. Virginia law also requires certain insurance information to be included in the officer’s report.

When Is an Accident Report Required?

Virginia law draws a few important lines:

  • Injury or death: If a crash results in injury or death, the driver must immediately notify a law-enforcement officer. 
  • When police must file an official report with DMV (FR300): If an officer investigates a crash involving injury or death, or apparent total property damage of $3,000 or more, the officer must forward a written crash report to the Virginia DMV (generally within 24 hours after completing the investigation). 

For minor crashes with no injuries—and where damage appears below that reporting threshold—a formal police crash report may not be generated. Even then, it can still be smart to document the scene thoroughly and consider reporting the incident if you expect an insurance claim or a dispute later.
